Product Liability

Wrongful Death

When family members lose a loved one because of the negligence or wrongful act of another party, they may be entitled to recover punitive damages to punish the wrongdoer and prevent similar harm from occurring to others. Alabama law is unique from other states in regard to the type of recoverable damages in a wrongful death action. Dram Shop

Alabama law allows spouses, parents and children of loved ones that are injured, damaged and/or killed by an intoxicated person to bring a lawsuit against a bar or business that illegally serves alcohol to the intoxicated person. Alabama law permits the damaged family member to recover both compensatory and punitive damages against the bar or business in such a situation. If you or someone you love has been injured by a drunk driver, there may exist a cause of action against not only the intoxicated person who caused the injury, but also the bar or business that furnished the alcohol.
